1. Contract
1.1 Your contract for purchases made through the Site is with OrientalDirect (we, us, our), Premire House, Lock Hill Mills, Holmes Road, Sowerby Bridge , HX6 3LD , United Kingdom
1.2 We do have the right to terminate the contract in the event that the products are unavailable, mispriced or cleared funds are not received.
1.3We do have right to change these terms of sale without notice to you in relation to future sales.
2. Products, pricing and availability
2.1 The price and availability of the products you order will be as shown on our website at the time you place your order.
2.2 Despite our best efforts, we can not guarantee there is no products are mispriced. If an error is found, we will inform you as soon as possible. If a product's correct price is lower than our stated price, we charge the lower amount and send you the product. If a product's correct price is higher than our stated price, we will, at our discretion, either contact you for instructions before dispatch or cancel your order and notify you of such cancellation.
2.3 We can not guarantee that the availability of products shown is accurate at the time you place your order. If the product you ordered is unavailable, we will inform you as soon as possible to cancel the contract and refund you if any sum has been paid by you
2.4 All Sizes and weights in the descriptions of products are approximate.
2.5 All product images are for illustrative purposes only and may differ from the actual product.
3. Payments
3.1 Payment for the products and delivery charges can be made by any method shown on our website at the time you place your order. Payment must be paid within 14 days after your place your order or inform us the date of payment you choose, breach of this term of agreement will result in exterminating the contract immediately.
3.2 Your order will not be dispatched until the clear payments are received
4. Delivery
4.1 The products you order will be delivered to the address you give when you place your order. If delivery cannot be made to your address for reasons under our control we will inform you as soon as possible.
4.2 The products you order will be delivered using the shipping method you choose when you place your order. You need to pay the delivery charge which includes packaging and handling charges
4.3 Best efforts are made to ensure that the products you order will be dispatched within 24 hours (except weekends and bank holidays); however, the delay may occur due to unforeseen events, we will inform you if the delay is over 48 hours
4.4 We will not liable for any delay, loss or damage caused by courier company, e.g. Royal Mail, however, we will assist you to claim compensation from them.
4.5 We only deliver products to the addresses in all the EU countries, Switzerland , Norway , Israel, USA , Canada , Japan , Australia , New Zealand and Singapore . We will determinate the contract if your delivery address is not in the countries above. We will refund you if any sum has been paid.
5. Limitation of Liability
5.1 Subject to 5.2 below, if you are a consumer the Supplier shall not be liable to you for any loss or damage in circumstances where:
5.1.1 there is no breach of a legal duty owed to you by the Supplier or by its employees or agents;
5.1.2 such loss or damage is not a reasonably foreseeable result of any such breach;
5.1.3 any increase in loss or damage resulting from breach by you of any term of this contract.
5.2 Nothing in these conditions excludes or limits the liability of the Supplier for death or personal injury caused by our negligence or fraudulent misrepresentation.
5.3 If you are a business customer the Supplier shall not be liable to you for any indirect or consequential loss or damage (whether for loss of profit, loss of business, depletion of goodwill or otherwise), costs, expenses or other claims for consequential compensation whatsoever (howsoever caused) which arise out of or in connection with this agreement.
6. Cancellation of contract
6.1 You have the right to cancel the contract at any time up to the end of 7 working days after you receive the goods (see below).
6.2 To exercise your right of cancellation, you must give written notice to us by hand, post or email, giving details of the goods ordered and (where appropriate) their delivery. Notification by phone is not sufficient.
6.3 Except in the case of faulty or misdescribed goods, if you exercise your right of cancellation after the goods have been delivered to you, you will be responsible for returning the goods to us at your own cost. The goods must be returned to the address shown below. You must take reasonable care to ensure the goods are not damaged in the meantime or in transit. In the case of faulty or misdescribed goods we shall ask you to return the goods yourself and possibly refund you the reasonable postage costs.
6.4 Once you have notified us that you are cancelling the contract and the returned products are received in satisfied condition, we will refund you within 10 working days for any sum that has been paid by you.
6.5 You do not have the right to cancel the contract if the order is for packages that have been unsealed by you, or for consumable goods which, by their nature, cannot be returned, save where a fault is discovered which could not have been discovered otherwise than by unsealing the goods.
